Bio

Nelson is a member of the firm’s Commercial Litigation and Government Contracting practice groups. He assists companies and individuals involved in disputes in state and federal courts, and before arbitration tribunals.  

Nelson’s practice focuses on complex litigation, representing clients in commercial disputes involving contracts, business torts, trade secrets, and unfair and deceptive trade practices. Nelson also litigates intellectual property disputes, including defense and prosecution of trademark infringement claims, copyright infringement claims, and proceedings before the U.S. Patent & Trademark Office’s Trademark Trial and Appeal Board (“TTAB”).  He regularly advises clients on private party and government contracts and regarding federal and state laws.  Nelson graduated from the University of North Carolina School of Law with Honors. He received his B.A. in Journalism and Political Science with Distinction from UNC-Chapel Hill.

During law school, Nelson was a Notes Editor on the North Carolina Journal of Law and Technology and member of the Holderness Moot Court Negotiation team. He also received a Pro Bono Publico award for the volunteer legal work he provided in the community.

Representative Experience 

  • Represented commercial painting company in successful multi-million-dollar appeal of a federal agency decision.
  • Obtained early dismissal of all claims for real estate company on dispositive motion in North Carolina Superior Court, including claims for unfair and deceptive trade practices, tortious interference, and civil conspiracy.
  • Represented large automotive company in defense of a claim for tortious interference with contract filed by a competitor resulting in dismissal for lack of personal jurisdiction.
  • Represented municipality in developer’s appeal of the denial of applications for special use permits on a Petition for Writ of Certiorari to North Carolina Superior Court resulting in affirmance of the municipality’s written decision.
  • Obtained favorable settlement for a regional software-as-a-service company enforcing a breach of contract against a large multinational corporation.
  • Represented diversified services company in a lawsuit arising out of various state agencies’ failures to pay compensation owed under a government contract pursuant to an equitable adjustment clause resulting in a favorable multi-million-dollar settlement.
  • Obtained summary judgment in federal court on all claims for large automotive company, including claims for breach of contract, tortious interference, and unfair competition.
  • Represented publicly-traded private aviation company in defense of various contract and tort claims in the Commercial Division of the Supreme Court of New York resulting in dismissal for lack of personal jurisdiction.
  • Obtained judgment on the pleadings in North Carolina Superior Court for a group of landowners against a municipality for violations of a municipal ordinance in the approval of a preliminary plat for a proposed development.
